Terms & Conditions
Last updated: · Template document — have it reviewed by a qualified lawyer in each country you operate in before publishing.
These terms apply to your use of this website and, where stated, to services provided by Digital Services Agency (“we”, “us”). Individual projects are governed by a separate signed agreement, which takes precedence over these terms if the two conflict.
What we do
We are a technology and software development company. We provide blockchain development, token generation and launch support, smart contract development, Web3 and DApp development, website and application development, custom software and digital marketing services.
What we are not
- We are not a financial adviser, investment adviser, broker, exchange or token issuer.
- Nothing on this website is financial, investment, tax or legal advice.
- Nothing on this website is an offer to sell, or a solicitation to buy, any digital asset or security.
No guarantees about tokens or markets
Where we provide token development or launch support, our role is technical. We do not guarantee, and cannot control:
- token price, market value, returns or profits;
- investor interest, holder numbers or trading volume;
- acceptance or approval by any centralized or decentralized exchange;
- liquidity levels or the behaviour of any liquidity pool;
- the future policies of any blockchain network or third-party platform.
Digital assets are volatile and can lose all of their value. Any decision to create, hold or transact in a digital asset is yours alone.
Your legal and regulatory responsibilities
Token and digital asset regulation differs significantly between countries and changes frequently. It is your responsibility to obtain independent legal advice and to comply with all applicable laws, including securities, consumer protection, anti-money-laundering and tax requirements, in every jurisdiction where you operate or offer your project. We may decline or stop work on any project we believe to be unlawful, misleading or harmful.
Quotes, scope and payment
- Quotes are based on the scope agreed in writing. Changes to scope may change cost and timeline.
- Timelines are estimates that assume timely feedback, content and approvals from you.
- Payment terms, milestones and deposits are set out in the project agreement.
Intellectual property
On full payment, ownership of custom deliverables produced specifically for your project transfers to you, except for third-party components, open-source libraries and our pre-existing tools and frameworks, which are licensed to you for use within the delivered work. Website content, branding and images on this site remain our property.
Third-party services
Projects often depend on third parties — blockchain networks, exchanges, wallets, hosting, payment processors, advertising platforms and app stores. We are not responsible for their availability, policies, fees, approval decisions or changes to them.
Security and audits
We follow security-conscious development practices, including code review and testing. No software is completely free of defects. For smart contracts that will hold or move significant value, we recommend an independent third-party audit in addition to our own review, and we are not liable for losses arising from vulnerabilities in code that was deployed without one.
Support and maintenance
Post-launch support is provided where it is included in your agreement. Its scope and duration are defined there.
Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost data, market losses or loss of business opportunity. Nothing in these terms limits liability that cannot be limited by law.
Website content
Projects shown in our portfolio and marked “Demo” are internal reference builds created to demonstrate our approach, not live client deployments. Testimonials marked as samples are placeholder content. We do not claim official partnership with any blockchain network, exchange or platform mentioned on this site.
Changes
We may update these terms. Continued use of the website after an update means you accept the revised terms.
